WASHINGTON — The Supreme Court has punted in census case and declined to issue a definitive ruling on Trump’s plan to exclude illegal aliens from the population count used to re-apportion U.S. House seats.
In the unsigned opinion, the court says, “At present, this case is riddled with contingencies and speculation that impede judicial review.” The court said the challenge was “premature.”
Justices Breyer, Sotomayor and Kagan dissent, saying they would strike down the policy right now.
